DESTINATION 48NORTH TRAVEL
48North Consulting Group Inc., doing business as Destination 48North Travel (“Destination 48North Travel”), is a company duly incorporated in the City of Victoria, in the Province of British Columbia, Canada, under registration number BC0834047.
TERMS AND CONDITIONS
These are the terms and conditions of service for Destination 48North Travel (the “Terms and Conditions”). Please read carefully all the information in these Terms and Conditions as their acceptance constitutes a legally binding contract between you (the “Customer”) and Destination 48North Travel.
DEFINITIONS
In and for the purposes of these Terms and Conditions, unless there is something in the subject matter or context inconsistent therewith or unless otherwise specifically provided, each of the words, phrases and expressions described in this section shall have the meanings ascribed thereto:
“Final Itinerary” means the itinerary provided to the Customer by Destination 48North Travel subsequent to providing the Customer with a Quote.
“Reservation” means the reservation of any travel component to be secured by Destination 48North Travel.
“Travel Component” includes, but is not limited to, any or all of the accommodation, transportation, or activity arrangements secured by Destination 48North Travel on behalf of the Customer.
“Quote” means the quote for any or all Travel Components secured by Destination 48North Travel as forwarded to the Customer prior to Reservation.
DEEMED ACCEPTANCE
Upon Reservation and making a deposit or full payment for any Travel Component or service provided by Destination 48North Travel, the Customer is required and deemed to understand, accept and agree to all of the Terms and Conditions herein, and to further understand, accept and agree to any and all other specific or implied terms and conditions provided at the time of the Quote being sent to the Customer.
IMPLIED TERMS AND CONDITIONS
Destination 48North Travel acts as agent for various companies in the travel and tourism industry (the “Suppliers”) whose services may be sought by the Customer. The Suppliers are independent third parties over whom Destination 48North Travel exercises no direct or indirect control or supervision. The Customer should familiarize themselves with any and all terms and conditions of the Suppliers chosen. By using our services and accepting an itinerary you are agreeing to the terms and conditions of the Suppliers whose services you are using and are further agreeing that you are aware of and understand and accept such Suppliers' terms and conditions of service. If you cannot locate these terms, please contact us and we can provide you with them. It is the Customer’s responsibility to review the invoice and itinerary and ensure that they are correct and reflect the requested travel arrangements.
QUOTES
At Destination 48North Travel we do our best to obtain the best rates available for the Customer. This may include special offer rates from the Suppliers that have time restrictions and/or limited availability. Rates may also be subject to specific seasonal or calendar date restrictions. For these reasons, Destination 48North Travel cannot provide accurate Quotes spanning more than 14 days. As such, all Quotes presented by Destination 48North Travel will expire 14 days after presentation to the Customer.
RESERVATIONS
When making a Reservation, please provide the following information:
(a) Reference to the adequate vacation package or quote provided by Destination 48North Travel;
(b) Surname, given name and title of all passengers;
(c) Ages of all fellow travelers;
(d) Desired arrival and departure dates, times and coordinates (flight, hotel, etc);
(e) Personal preferences (bedding configuration, smoking or non-smoking, dietary restrictions, etc). Please note these requests are dutifully noted and forwarded to the Suppliers but cannot be guaranteed;
(f) Any further restrictions or special conditions that might affect the trip;
(g) Your credit card number.
This information helps us to process requests diligently and respond as soon as possible with a confirmation and your final itinerary.
DEPOSITS
To secure any Travel Component we require a 25% deposit of the total costs, as indicated in the invoice forwarded with the Quote provided to the Customer, within 3 days after you receive your Final Itinerary. All deposits paid are non-refundable.
PAYMENTS
The balance of all funds outstanding as indicated on the Final Itinerary are due 20 days prior to the use of any Travel Component as indicated on your Final Itinerary. Any Reservation made less than 20 days prior to the use of any Travel Component is subject to immediate full payment. Late payments may result in an automatic cancellation for which no refund can or will be issued.
CURRENCY
Although Quotes may be forwarded to you in the currency of your jurisdiction, all payments must be in Canadian funds. Destination 48North Travel must process all charges or fees in the equivalent Canadian fund amounts.
PAYMENT METHODS
The following forms of payment are accepted:
a) personal cheques;
b) money orders;
c) direct bank transfers and/or wire payments; and
d) We accept Visa, MasterCard and American Express. Please note: credit cards are accepted with a supplementary processing fee of 2% (the “Processing Fee”). This Processing Fee will be added to your final invoice at the time of Reservation.
Please make all cheques or money orders payable to “Destination 48North Travel”.
SERVICE FEES
Service fees may apply when Destination 48North Travel incurs additional charges from its Suppliers (e.g. hotels). These service fees may include taxes and service recovery charges which will be the responsibility of the Customer.
LIABILITY
The Customer hereby agrees that Destination 48North Travel assumes no responsibility for and shall not be expected, asked, or required to pay for any financial loss, personal injury, property damage, other loss, accident, delay, inconvenience, loss of employment or irregularity which you or your traveling companions may experience either by reason of:
(a) Non-performance due to the bankruptcy, insolvency, receivership or cessation of operations or for any reason whatsoever of any Supplier whose services you have engaged;
(b) Wrongful, careless, negligent acts or omissions on the part of any Supplier or its employees or agents or on the part of any other party not under our control;
(c) Any defect, breakdown or other failure of any aircraft, train, bus, automobile, ship, accommodation or other equipment owned and operated by a supplier;
(d) Terrorist activities, social or labour unrest, construction difficulties, diseases, local laws, climate conditions, abnormal conditions, or developments or any other actions, omissions or conditions outside our control; or
(e) The Customer’s failure to obtain required documentation, including passports, travel visas, health certificates where required or passengers being denied into Canada for any reasons.
INSURANCE
Many of the problems for which Destination 48North Travel cannot be responsible can be insured against. We strongly recommend that you obtain appropriate travel insurance coverage (cancellation insurance or all-inclusive insurance). Short-term travel insurance policies can cover non-refundable trip costs due to personal or family illness or accident. Destination 48North Travel does not provide insurance coverage. It is the Customer’s responsibility to ensure that adequate insurance coverage has been obtained.
CANCELLATION
Once full and final payment has been made and the reservation process is completed, all of the services and Travel Components purchased from Destination 48North Travel as described on your invoice and Final Itinerary are non-refundable. Where change and/or cancellation is possible, the Customer hereby acknowledges and agrees that such a change or cancellation may require the payment of penalties or administrative fees, which may equal or exceed the full price paid for the service being changed or cancelled as determined by the Suppliers. The Customer further acknowledges and agrees that Destination 48North Travel shall apply a service charge for assisting in the processing of the change or cancellation.
Destination 48North Travel reserves the right to cancel, modify, or alter all or any part of the Final Itinerary when necessary or advisable. In the event of such change(s), Destination 48North Travel endeavors to substitute comparable or superior services or provide a full refund for any individual component being cancelled. A full refund of monies paid by Destination 48North Travel for the individual Travel Component shall constitute a full and final settlement between Destination 48North Travel and the Customer.
Any cancellation must be made in writing and must include a written confirmation of cancellation from Destination 48North Travel.
Please inform other travel companions of these Terms and Conditions. Before utilizing any services or Travel Components provided by Destination 48North Travel, Destination 48North Travel requires written confirmation that you have read and accepted these Terms and Conditions.
